TERMS OF USE Punktured Art Tattoo Studio — Terms of Use
Last updated: February 18, 2026These Terms of Use ("Terms") govern your use of the website located at HTTPS://WWW.PUNKTUREDART.COM (the "Site"), operated by Punktured Art Tattoo Studio ("Punktured Art", "we", "us", or "our"), located at 3645 Gossett Rd #212, West Kelowna, BC V4T 2N8. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the SiteThe Site is intended for individuals who are 18 years of age or older. By using the Site, you confirm that you meet this age requirement. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. You may not use the Site to transmit any unsolicited or unauthorized advertising, spam, or harmful content.
2. Booking and AppointmentsSubmitting a booking inquiry through the Site does not guarantee an appointment. All bookings are subject to artist availability and confirmation by Punktured Art. We reserve the right to decline any booking request at our discretion.
3. DepositsA non-refundable deposit may be required to secure your appointment. This deposit is applied toward the final cost of your tattoo. Deposits are non-refundable if you cancel without sufficient notice, fail to attend your appointment, or make significant changes to your design after the deposit has been paid. Deposit amounts will be communicated at the time of booking confirmation.
4. Cancellation and Rescheduling PolicyWe require a minimum of 48 hours notice to reschedule or cancel an appointment. Cancellations or no-shows with less than 48 hours notice will result in forfeiture of your deposit. Repeated cancellations or rescheduling may result in a new deposit being required or refusal of future bookings.
5. Health and SafetyClients must disclose any relevant medical conditions, allergies, or medications that may affect the tattooing process prior to their appointment. Tattooing is not performed on individuals who are pregnant, under the influence of alcohol or drugs, or who have certain medical conditions. Punktured Art reserves the right to refuse service if, in the artist's judgment, proceeding would pose a health or safety risk.
6. Age RequirementTattooing is strictly for individuals 18 years of age or older. Valid government-issued photo identification will be required at the time of your appointment. We will not tattoo anyone under the age of 18 under any circumstances.
7. Intellectual PropertyAll original tattoo designs created by Punktured Art artists remain the intellectual property of the artist unless otherwise agreed in writing. By commissioning a custom design, you are granted a personal, non-commercial license to wear the tattoo. You may not reproduce, sell, or use the design for commercial purposes without the artist's written consent. All content on the Site, including images, text, logos, and graphics, is owned by or licensed to Punktured Art and may not be copied or used without permission.
8. Aftercare ResponsibilityProper aftercare is the sole responsibility of the client. Punktured Art provides aftercare instructions and guidance, but we are not responsible for any issues arising from failure to follow those instructions, allergic reactions, infections, or natural healing variations. Touch-ups due to poor aftercare may be subject to additional charges.
9. Limitation of LiabilityTo the fullest extent permitted by applicable law, Punktured Art and its artists shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services, including but not limited to dissatisfaction with a healed tattoo result due to factors outside our control (skin type, aftercare, sun exposure, etc.).
10. Third-Party LinksThe Site may contain links to third-party websites. These links are provided for your convenience only. Punktured Art has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
11. Governing LawThese Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
12. Changes to These TermsWe may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
